Terms and Conditions

1.           Acceptance of Terms

 

    1.1.        By purchasing and using equipment manufactured by Rypar Pty Ltd, hereinafter referred to as "the Manufacturer," you agree to be bound by these Terms and Conditions. Please read these Terms carefully before using our products.

2.           Warranty

 

    2.1.        The Manufacturer warrants that all its products are free from defects in materials and workmanship for a period of 12 months from the date of delivery.

 

    2.2.        This warranty does not cover damage resulting from:

        2.2.1.    Misuse or accidents.

        2.2.2.    Unauthorized alterations.

        2.2.3.    Natural hazards including, fire, flood, lightning strikes, animal damage (insects, birds, reptiles, or mammals).

3.           Conditions of use

​

    3.1.        This warranty is subject to the customer complying with the following conditions:

        3.1.1.    All products are operated according to the relevant product datasheets.

        3.1.2.    The product has been installed according to the relevant installation instructions.

        3.1.3.    The product has not been tampered with, modified, disabled, or used for purposes other than field data collection.

        3.1.4.    The product was purchased either directly from the Manufacturer or from an authorised reseller.

        3.1.5.    The case temperature does not exceed the range -20°C to +80°C.

        3.1.6.    The product is not submerged >300mm in depth and not at all for a duration >1 hour.

4.           Returns and Refunds

 

    4.1.        If the customer finds any defects or damage with hardware the customer must notify the Manufacturer within 5 business days of delivery. The Manufacturer may choose to replace the goods or provide a full refund within 30 days of receiving the notification.

5.           Product Support

 

    5.1.        The Manufacturer provides customer support for its products during normal business hours (9.00am to 5.00pm, Monday to Friday).

6.           Limitation of Liability

 

    6.1.        The Manufacturer shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of its products, including those caused by omissions in documentation, installation, integration of third-party hardware or cyber-attack.

7.           Intellectual Property

 

    7.1.        All intellectual property rights, including patents, trademarks, and copyrights, related to the Manufacturer's products and materials, are owned by the Manufacturer.

8.           Governing Law

 

    8.1.        These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia.

 

​

9.           Force Majeure

​

    9.1 In the event of force majeure neither party shall be liable for any costs associated with the delay or failure to perform its obligations under these terms.

    9.2 In such an event, the effected party (customer or manufacturer) is obliged to notify the other party without delay on the specifics of the force majeure and remedy the situation to the best of their ability without delay.

10.         Changes to Terms

 

    10.1.     The Manufacturer reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on our website.
